Cyber-Surveillance in Everyday Life

I wanted to let readers know that the New Transparency Project is hosting an international workshop on the theme of Cyber-surveillance in everyday live May 12-15, 2011 at the University of Toronto. Given that topics to be explored in the workshop include social networking, search engines, behavioural advertising/marketing, internet surveillance somewhat generally, and modes of resistance I thought readers here might be interested. Below is the full call for papers, with abstracts due by Oct 1.:

Digitally mediated surveillance (DMS) is an increasingly prevalent, but still largely invisible, aspect of daily life. As we work, play and negotiate public and private spaces, on-line and off, we produce a growing stream of personal digital data of interest to unseen others. CCTV cameras hosted by private and public actors survey and record our movements in public space, as well as in the workplace. Corporate interests track our behaviour as we navigate both social and transactional cyberspaces, data mining our digital doubles and packaging users as commodities for sale to the highest bidder. Governments continue to collect personal information on-line with unclear guidelines for retention and use, while law enforcement increasingly use internet technology to monitor not only criminals but activists and political dissidents as well, with worrisome implications for democracy.

Analyzing the Verizon-Google Net Neutrality Framework

Technology is neither good or bad. It’s also not neutral. Network neutrality, a political rallying cry meant to motivate free-speech, free-culture, and innovation advocates, was reportedly betrayed by Google following the release of a Verizon-Google policy document on network management/neutrality. What the document reveals is that the two corporations, facing a (seemingly) impotent FCC, have gotten the ball rolling by suggesting a set of policies that the FCC could use in developing a network neutrality framework. Unfortunately, there has been little even-handed analysis of this document from the advocates of network neutrality; instead we have witnessed vitriol and over-the-top rhetoric. This is disappointing. While sensational headlines attract readers, they do little to actually inform the public about network neutrality in a detailed, granular, reasonable fashion. Verizon-Google have provided advocates with an opportunity to pointedly articulate their views while the public is watching, and this is not an opportunity that should be squandered with bitter and unproductive criticism.

I’m intending this to be the first of a few posts on network neutrality.[1] In this post, I exclusively work through the principles suggested by Verizon-Google. In this first, and probationary, analysis I will draw on existing American regulatory language and lessons that might be drawn from the Canadian experience surrounding network management. My overall feel of the document published by Verizon-Google is that, in many ways, it’s very conservative insofar as it adheres to dominant North American regulatory approaches. My key suggestion is that instead of rejecting the principles laid out in their entirety we should carefully consider each in turn. During my examination, I hope to identify what principles and/or their elements could be usefully taken up into a government-backed regulatory framework that recognizes the technical, social, and economic potentials of America’s broadband networks.

IPv6 and the Future of Privacy

There is an increasing urgency to transition to a new infrastructure for addressing space on the Internet, and in this space all individuals and their devices could be uniquely identifiable by their Internet Protocol (IP) address(es). It is in light of this surveillant future that France’s recent ruling that IP addresses are not personally identifiable information is so serious. Further, it is with this longer temporal viewpoint (i.e. not just the here and now) that has more generally worried technologists about governmental rulings concerning binary ‘yes/no IP addresses are private information’.

Before I go any further, let me break down what an IP address is, the distinctions between versions 4 (IPv4) and 6 (IPv6), and then get to the heart of the privacy-related issues concerning the transition to IPv6. The technical infrastructure of the ‘net tends to be seen as dreadfully boring but, as is evidenced by the (possible) computer failures of Toyota vehicles, what goes on ‘under the hood’ of the ‘net is of critical importance to understand and think about. It’s my hope that you’ll browse away with concerns and thoughts about the future of privacy in an increasingly connected biodigital world.

I tend to (almost exclusively) access key websites related to my research and personal interests through RSS feeds. As a result of using Google Reader to collate new content, I rarely actually see the blogrolls and suggested links that are provided by those key websites that I grab content from on a daily basis. Given that I’m sure many people read this site almost exclusively through RSS, I wanted to prepare a short piece that highlights just some of the key blogs and websites that I turn to on a regular basis in the hopes that readers might find some cool and interesting new sources of information they’d otherwise never come across. As a hat tip, this post is largely inspired by Rebecca Bollwitt‘s “The Missing Link” that considers (as of 2008) the changing characters of link lists and blogrolls.

The Geek, Restraining Orders, and Theories of Privacy

restrainingorderI’ve been reading some work on privacy and social networks recently, and this combined with Ratliff’s “Gone Forever: What Does It Really Take to Disappear” has led me to think about whether a geek with a website that is clearly their own (e.g. Christopher-Parsons.com) should reasonably expect restraining laws to extend to digital spaces. I’m not really talking at the level of law necessarily, but at a level of normativity: ought a restraining order limit a person from ‘following’ me online as it does from being near me in the physical world?

Restraining orders are commonly issued to prevent recurrences of abuse (physical or verbal) and stalking. While most people who have a website are unable to track who is visiting their webspace, what happens when you compulsively check your server logs (as many good geeks do) and can roughly correlate traffic to particular geo-locations. As a loose example, let’s say that you were in a small town, ‘gained’ an estranged spouse, and then notice that there are regular hits to your website from that small town after you’ve been away from it for years. Let’s go further and say that you have few/no friends in that town, and that you do have a restraining order that is meant to prevent your ex-spouse from being anywhere near you. Does surfing to your online presence (we’ll assume, for this posting, that they aren’t commenting or engaging with the site) normatively constitute a breach of an order?

Background to North American Politics of Deep Packet Inspection

crtc566The CRTC is listening to oral presentations concerning Canadian ISPs’ use of Deep Packet Inspection (DPI) appliances to throttle Canadians’ Internet traffic. Rather than talk about these presentations in any length, I thought that I’d step back a bit and try to outline some of the attention that DPI has received over the past few years. This should give people who are newly interested in the technology an appreciation for why DPI has become the focus of so much attention and provide paths to learn about the politics of DPI. This post is meant to be a fast overview, and only attends to the North American situation given that it’s what I’m most familiar with.

Massive surveillance of digital networks took off as an issue in 2005, when the New York Times published their first article on the NSA’s warrantless wiretapping operations. The concern about such surveillance brewed for years, but (in my eyes) really exploded as the public started to learn about the capacities of DPI technologies as potential tools for mass surveillance.

DPI has been garnering headlines in a major way in 2007, which has really been the result of Nate Anderson’s piece, “Deep packet inspection meets ‘Net neutrality, CALEA.” Anderson’s article is typically recognized as the popular news article that put DPI on the scene, and the American public’s interest in this technology was reinforced by Comcast’s use of TCP RST packets, which was made possible using Sandvine equipment. These packets (which appear to have been first discussed in 1981) were used by Comcast to convince P2P clients that the other client(s) in the P2P session didn’t want to communicate with Comcast subscriber’s P2P application, which led to the termination of the data transmission. Things continued to heat up in the US, as the behavioural advertising company NebuAd began partnering with ISPs to deliver targeted ads to ISPs’ customers using DPI equipment. The Free Press hired Robert Topolski to perform a technical analysis of what NebuAd was doing, and found that NebuAd was (in effect) performing a man-in-the-middle attack to alter packets as they coursed through ISP network hubs. This report, prepared for Congressional hearings into the surveillance of Americans’ data transfers, was key to driving American ISPs away from NebuAd in the face of political and customer revolt over targeted advertising practices. NebuAd has since shut its doors. In the US there is now talk of shifting towards agnostic throttling, rather than throttling that targets particular applications. Discrimination is equally applied now, instead of honing in on specific groups.

In Canada, there haven’t been (many) accusations of ISPs using DPI for advertising purposes, but throttling has been at the center of our discussions of how Canadian ISPs use DPI to delay P2P applications’ data transfers. Continue reading
