Deep Packet Inspection and Law Enforcement

rcmpCandace Mooers asked me a good question today about deep packet inspection (DPI) in Canada. I’m paraphrasing, but it was along the lines of “how might DPI integrate into the discussion of lawful access and catching child pornographers?” I honestly hadn’t thought about this, but I’ll recount here what my response was (that was put together on the fly) in the interests of (hopefully) generating some discussion on the matter.

I’ll preface this by noting what I’ve found exceptional in the new legislation that was recently presented by the Canadian conservative government (full details on bill C-47 available here, and C-46 here) is that police can require ISPs to hold onto particular information, whereas they now typically required a judicial warrant to compel ISPs to hold onto particular data. Further, some information such as subscriber details can immediately be turned over to police, though there is a process of notification that must immediately followed by the officers making the request. With this (incredibly brief!) bits of the bills in mind, it’s important for this post to note that some DPI appliances are marketed as being able to detect content that is under copyright as it is transferred. Allot, Narus, ipoque, and more claim that this capacity is built into many of the devices that they manufacture; a hash code, which can be metaphorically thought of like a digital fingerprint, can be generated for known files under copyright and when that fingerprint is detected rules applied to the packet transfer in question. The challenge (as always!) is finding the processor power to actually scan packets as they scream across the ‘net and properly identify their originating application, application-type, or (in the case of files under copyright) the actual file(s) in question.

Iran, Traffic Analysis, and Deep Packet Inspection

iranelectionLet me start with this: I am woefully ignorant and Iranian politics, and have no expertise to comment on it. I’ll save my personal thoughts on the matter for private conversations rather than embarrass myself by making bold and ignorant statements here. Instead, I want to briefly note and comment on how the Wall Street Journal (WSJ) is talking about Deep Packet Inspection (DPI) and the data traffic that is flowing in and out of Iran.

The WSJ has recently disclosed that Iranian network engineers are using DPI to examine, assess, and regulate content that is entering and exiting Iran. They note that the monitoring capacity was, at least in part, facilitated by infrastructure that was sold by Nokia-Simens. The article proceeds, stating that traffic analysis processes have been experimented with before, though this is the first major deployment of these processes that has captured the attention of the world/Western public. This is where things start getting interesting.

The article notes that;

The Iranian government had experimented with the equipment for brief periods in recent months, but it had not been used extensively, and therefore its capabilities weren’t fully displayed – until during the recent unrest, the Internet experts interviewed said.

Deep Packet Inspection and the Confluence of Privacy Regimes

insiderouterI learned today that I was successful in winning a Social Sciences and Human Research Council (SSHRC) award. (Edit September 2009: I’ve been upgraded to a Joseph Armand Bombardier Canada Graduate Scholarship). Given how difficult I found it to find successful research statements (save for through personal contacts) I wanted to post my own statement for others to look at (as well as download if they so choose). Since writing the below statement, some of my thoughts on DPI have become more nuanced, and I’ll be interested in reflecting on how ethics might relate to surveillance/privacy practices. Comments and ideas are, of course, welcomed.

Deep Packet Inspection and the Confluence of International Privacy Regimes

Context and Research Question

Internet Service Providers (ISPs) are ideally situated to survey data traffic because all traffic to and from the Internet must pass through their networks. Using sophisticated data traffic monitoring technologies, these companies investigate and capture the content of unencrypted digital communications (e.g. MSN messages and e-mail). Despite their role as the digital era’s gatekeepers, very little work has been done in the social sciences to examine the relationship between the surveillance technologies that ISPs use to survey data flows and the regional privacy regulations that adjudicate permissible degrees of ISP surveillance. With my seven years of employment in the field of Information Technology (the last several in network operations), and my strong background in conceptions of privacy and their empirical realization from my master’s degree in philosophy and current doctoral work in political science, I am unusually well-suited suited to investigate this relationship. I will bring this background to bear when answering the following interlinked questions in my dissertation: What are the modes and conditions of ISP surveillance in the privacy regimes of Canada, the US, and European Union (EU)? Do common policy structures across these privacy regimes engender common realizations of ISP surveillance techniques and practices, or do regional privacy regulations pertaining to DPI technologies preclude any such harmonization?

I See Your DPI and Raise You a SSL

A little while ago I was talking about network neutrality and Deep Packet Inspection (DPI) technologies with a person interested in the issue (shocking, I know), and one of the comments that I made went something like this: given the inability of DPI technologies to effectively crack encrypted payloads, it’s only a matter of time until websites start to move towards secure transactions – in other words, it’s only a matter of time until accessing websites will involve sending encrypted data between client computers and servers.

The Pirate Bay and Beyond

Recently, Sweden passed a bill that allows for the wiretapping of electronic communications without a court order. This caused the Pirates Bay, a well-known BitTorrent index site, to announce that it was adding SSL encryption to their website as well as VPN solutions for native Swedes who wanted to avoid the possibility of having their network traffic surveyed. Recently, isohunt.com has done the same, and other major torrent sites are expected to follow the lead. The groups who are running these websites are technically savvy, allowing them to implement encrypted access rapidly and with little technical difficulty, but as more and more sites move to SSL there will be an increasing demand amongst tech-savvy users that their favorite sites similarly protect them from various corporate and government oversight methods.

DPI, Employees, and Proper Inspection

In my last post I alluded to the fact that Deep Packet Inspection (DPI) technologies could be used by businesses to try and reduce the possibility of ‘inappropriate’ employee use of bandwidth and wrongful or accidental transmissions of confidential IP. In that last post I was talking about IT security, and this post will continue to reflect on DPI technologies’ applications and benefits to and for corporate environments.

A Quick Refresher on DPI

The “deep” in deep packet inspection refers to the fact that these boxes don’t simply look at the header information as packets pass through them. Rather, they move beyond the IP and TCP header information to look at the payload of the packet. The goal is to identify the applications being used on the network, but some of these devices can go much further; those from a company like Narus, for instance, can look inside all traffic from a specific IP address, pick out the HTTP traffic, then drill even further down to capture only traffic headed to and from Gmail, and can even reassemble e-mails as they are typed out by the user. Shaping your Identity

It’s been a while since I’ve been updating this blog regularly – since I last wrote, I’ve completed my Master’s thesis, traveled to Brasil, sent out applications to Doctoral programs, found (temporary) full-time employment, and rested my brain a bit. Now, I feel rejuvenated, and ready to get back into the swing of things.

Setting the Stage

We are increasingly living in a hybrid world, one where our lives are being digitized. We eat food (analogue) but order it online (digital); we use our voices to talk with one another (analogue) using cell phones (digital); we read cooking recipes (analogue) from recipe websites (digital). In addition to what we actually do, what happens around us, and shapes how we are capable of interacting, often occurs within digital spaces – banking institutions are networked, government documents are send across departments by email, and major corporate executives that make (oftentimes) global decisions seem to have Blackberries surgically attached to themselves.
